1. Agreement to Terms

By requesting a quote or booking a service with Property Clearance Scotland Ltd (Company Number: [Insert if applicable] | Phone: 07395 741393), you agree to the following terms and conditions. We operate as a SEPA Registered Waste Carrier (License: WCR/R/3017045).

2. Legal Authority & Ownership of Goods

  • Warrant of Authority: The Client warrants that they have full legal authority, power, and rights to grant Property Clearance Scotland Ltd access to the premises and to authorize the disposal or removal of all items located therein.
  • Indemnity: The Client agrees to indemnify and hold Property Clearance Scotland Ltd harmless against any third-party claims, legal actions, or disputes arising from a lack of authority to dispose of specific items or a lack of legal right to access the property.
  • Transfer of Ownership: Once the invoice is paid in full we have full legal ownership of said items and transfers to Property Clearance Scotland Ltd for the purposes of disposal, recycling, donation, or resale.

3. Quotes & Asset Offsets

  • Quotes are provided based on the volume of waste, labor, and disposal fees.
  • If we identify high-quality furniture, collectibles, or resalable items during our assessment, an Asset Offset (valuation discount) may be applied to your final invoice at our professional discretion.

4. Booking, Deposits & Cancellations

  • Deposits: A non-refundable deposit is required to secure your clearance date. This covers administrative scheduling and the allocation of a dedicated team.
  • Final Payment: The remaining balance is due immediately upon completion of the clearance unless otherwise agreed in writing.
  • Cancellation Policy: * Cancellations made with more than 48 hours’ notice may have their deposit transferred to a future date at our discretion.
    • Cancellations made with less than 48 hours’ notice will result in the forfeiture of the deposit.
    • If our team arrives on-site and is unable to gain access or the job is cancelled at the door, a call-out fee will be charged.

5. Limitation of Liability

  • High-Value Items: It is the Client’s sole responsibility to remove any items of significant sentimental or financial value (e.g., jewelry, cash, small heirlooms, legal documents, stocks/bonds) prior to our arrival.
  • Hidden Items: We shall not be held responsible for the loss of any items left inside furniture, hidden under floorboards, or tucked away in lofts/cupboards that were not explicitly identified to our team in writing before the clearance began.
  • Property Damage: While we exercise extreme care, we are not liable for minor scuffs to walls, doorframes, or flooring incidental to moving heavy, bulky, or awkward items in confined spaces, unless caused by gross negligence.

6. Prohibited Items (Exclusions)

Unless specifically agreed in writing and quoted separately, we cannot legally transport or dispose of:

  • Raw Asbestos or materials containing Asbestos.
  • Hazardous chemicals, solvents, paints, or oils.
  • Gas canisters, fire extinguishers, or pressurized cylinders.
  • Clinical, biological, or animal waste.
  • quantities of soil, stone, or heavy builders’ rubble.

7. Access & Parking

The Client must ensure clear and legal access to the property. Any parking fines or congestion charges incurred due to a lack of provided permits or inadequate parking arrangements will be added to the final invoice.

8. Our Promise

We use no sub-contractors. Your clearance will be handled by our direct, uniformed team. We aim to recycle or donate as much as possible, adhering strictly to SEPA guidelines to protect the Scottish environment.
