Definitions
Client
Refers to the individual or business specified in any quotation, estimate, or booking confirmation. This includes any authorised delegate whom Property Clearance Scotland Ltd (hereinafter “Property Clearance Scotland”) has agreed to provide services to.
Property
Means the premises or location where clearance or related services are to be conducted.
Company
Refers to Property Clearance Scotland Ltd, a company registered in Scotland with its office at 123 Brook Street, Alva, FK12 5AN.
Services
The tasks undertaken by Property Clearance Scotland, including removal, clearance, recycling, cleaning, and destruction, as agreed with the Client either in writing or verbally.
Service Agreement
- All work undertaken by Property Clearance Scotland is subject to these Terms and Conditions.
- These terms are deemed accepted when the Client confirms a booking or accepts a quotation.
- The Client must ensure that all items not to be removed are clearly marked or removed before the clearance begins. Anything else may be cleared, recycled, reused, or disposed of at our discretion.
- The Client grants us full authority to handle and dispose of items found on the Property by resale, donation, reuse, or lawful waste disposal.
Quotation & Scope
- All quotations are based on information provided by the Client.
- If the actual job differs materially from the information provided, we reserve the right to revise the quote to reflect additional work or cost.
Access, Authority, and Safety
By requesting us to enter and remove items from a Property, the Client warrants:
- They have the legal authority to grant access and authorise removal of contents.
- The Property is safe for entry and normal working operations.
- The Client will indemnify Property Clearance Scotland against all claims or losses resulting from any breach of these warranties.
If keys are posted or exchanged by mail, Property Clearance Scotland will not be liable for keys lost in transit.
Hazardous and Restricted Items
The Client must notify us of any items that may contain hazardous materials, such as:
- Asbestos
- Sharps
- Chemicals
- Biological waste
We do not dispose of hazardous materials.
Any hazardous waste must be removed by a licensed specialist before clearance.
We also do not disconnect gas, water, or hard-wired electrical items. These must be made safe and disconnected by a qualified professional before clearance begins.
Waste Ownership & Invoicing
- All waste on the Property remains the Client’s responsibility and ownership until our invoice is paid in full.
- We reserve the right to return waste to the Property if payment is not received on time.
- Invoices must be settled on the day of the clearance.
- If a job spans multiple days, payment is due at the end of each working day.
- We accept debit card or pre-agreed bank transfer.
- We do not accept cheques.
Delays and Cancellations
- We aim to carry out services on time. However, delays due to traffic, weather, or unforeseen events may occur. We will notify the Client and reschedule if needed.
- A cancellation fee of up to 70% will apply based on under 48 notice given and 30% for all other timeframes. Compassion will be applied in cases involving bereavement or stress-related situations.
Damage and Liability
- We take care to avoid property damage. If damage does occur, we will cooperate to resolve the issue.
- The Client must provide:
- Photographic evidence of the damage
- Three independent quotes on headed paper from accredited tradespeople
- Copies of all receipts and invoices for remedial works
- Without this documentation, we may be unable to process claims.
Confidentiality and Data
The Client confirms that any items removed do not contain confidential data unless otherwise stated. Any data-containing items that require special handling must be disclosed in advance. Property Clearance Scotland accepts no liability for claims arising from undisclosed data breaches.
Privacy & Marketing
- No identifiable personal information or photos will be used for marketing without consent.
- Clients must notify us if they do not wish images of their Property used in promotional content.
