1.Agreement to Terms

By requesting a quote or booking a service with Property Clearance Scotland Ltd (Phone: 07395 741393), you agree to the following Terms and Conditions.

Property Clearance Scotland Ltd operates as a SEPA Registered Waste Carrier. SEPA Waste Carrier Licence: WCR/R/3017045.

These Terms apply to all clearance, removals, transport, waste disposal, man and van, relocation, and associated services provided by Property Clearance Scotland Ltd.

2.Legal Authority, Ownership & Responsibility

The Client warrants that they have full legal authority, power, and rights to:

The person accepting the quotation shall be recognised as the "Client" and shall remain solely responsible for all instructions, permissions, and payment obligations.

Indemnity

The Client agrees to indemnify and hold harmless Property Clearance Scotland Ltd against any claims, disputes, losses, damages, legal proceedings, or costs arising from:

Transfer of Ownership

Upon full payment of the invoice, ownership of cleared items transfers to Property Clearance Scotland Ltd for lawful disposal, recycling, resale, donation, or processing.

3.Quotes & Asset Offsets

All quotations are based upon estimated waste volume, labour requirements, loading times, access conditions, disposal charges, and recycling costs. Quotes are subject to revision where conditions materially differ from those disclosed at booking.

Where reusable or resalable items are identified, Property Clearance Scotland Ltd may apply an Asset Offset discount at its sole professional discretion.

4.Booking, Deposits, Payment & Cancellations

Deposits

A non-refundable deposit may be required to secure booking dates, staffing, and vehicle allocation.

Final Payment

Full payment is due immediately upon completion of works unless otherwise agreed in writing. Payment must clear before our team vacates the property.

5.High-Value Items & Client Responsibility

⚠️ It is solely the Client's responsibility to remove or secure high-value items before clearance begins.

This includes but is not limited to: cash, jewellery, watches, precious metals, passports, legal documents, certificates, keys, digital storage devices, stocks or bonds, and sentimental items.

Property Clearance Scotland Ltd accepts no responsibility for hidden or undisclosed valuables.

6.Hidden Items

We shall not be liable for items left inside furniture, within drawers, in cupboards, under floorboards, in lofts or crawl spaces, or in bags, containers, or concealed compartments.

Clients must inspect all items before clearance or removals commence.

7.Access Risks & Structural Integrity

The Client is responsible for ensuring safe and lawful access to lofts, basements, garages, outbuildings, gardens, stairways, and all access routes.

We reserve the right to refuse access to unsafe areas including non-boarded lofts, weak flooring, structurally unstable areas, water-damaged areas, and unsafe staircases.

Where the Client instructs us to proceed despite identified risks, the Client accepts full liability for resulting damage.

8.Prohibited Items

⚠️ Unless separately agreed in writing, we cannot legally transport or dispose of the following items.

Prohibited items include: asbestos, hazardous chemicals, oils or fuels, gas cylinders, fire extinguishers, medical waste, biological waste, animal waste, firearms or ammunition, explosives, and excessive rubble or hardcore.

Discovery of prohibited materials may result in suspension of works and additional charges.

9.Access & Parking

The Client must provide suitable and legal access and parking arrangements. Any parking penalties, permit costs, congestion charges, tolls, or fines incurred due to inadequate arrangements shall be added to the final invoice.

10.Waste Disposal & Environmental Responsibility

Property Clearance Scotland Ltd aims to recycle, reuse, or donate suitable items wherever reasonably possible in accordance with SEPA regulations and Scottish environmental standards. All waste handling shall comply with applicable environmental legislation.

11.Staff & Subcontractors

Property Clearance Scotland Ltd primarily uses directly employed staff. Where subcontractors are required, they shall operate under our instruction and standards.

12.Removals & Transport Services

These additional terms apply to house removals, man and van services, furniture transport, relocation services, storage transport, and commercial moves.

13.Passenger Restrictions

For insurance and licensing reasons, customers or members of the public are not permitted to travel in company vehicles unless expressly authorised in writing. Our vehicles are insured for authorised staff and goods carriage only.

14.Customer Packing Responsibility

Where goods are packed by the Client, Property Clearance Scotland Ltd shall not be liable for damage resulting from poor packing, overloaded boxes, internal breakages, insufficient wrapping, or improper sealing. The Client is responsible for ensuring all items are suitably packed for transport.

15.High-Risk & Excluded Goods

Unless agreed beforehand in writing, we do not accept liability for transport of jewellery, cash, watches, precious metals, legal documents, securities, firearms, explosives, illegal substances, perishable items, plants, or animals.

High-value or fragile items must be declared before transport. We reserve the right to refuse unsafe or insufficiently packed goods.

16.Delays Beyond Our Control

We shall not be liable for delays caused by circumstances outside our reasonable control, including traffic, weather, road closures, vehicle breakdowns, access issues, lift failures, delays in property completion, or third-party delays. All timings are estimates only.

17.Damage to Goods & Limitation of Liability

Standard Liability

Unless otherwise agreed in writing, our liability for proven negligence shall be limited to £40 per item or the repair value of the item, whichever is lower. For the purposes of this agreement, a box, carton, package, drawer, or container shall constitute one item.

No "New for Old" Replacement

Compensation shall reflect age, wear and tear, depreciation, and second-hand market value. We do not provide "new for old" replacement compensation.

Fragile & Flat-Pack Furniture

We shall not be liable for damage to flat-pack, self-assembled, chipboard, pressed wood, previously repaired furniture, or furniture with pre-existing weakness, unless caused by gross negligence.

18.Damage to Property

Whilst reasonable care is exercised, we shall not be liable for minor cosmetic damage incidental to removals or clearances, including scuffs, scratches, carpet marks, paint damage, or minor wall or doorframe marks.

We accept no liability where items are moved against advice, access routes are restricted, property structures are already weakened, or damage results from hidden defects.

19.Claims Procedure

Any claim for loss or damage must be reported before completion where visible, and submitted in writing within 48 hours of completion. Claims may be rejected outside this period.

Clients may be required to provide photographs, proof of ownership, proof of value, and evidence of damage.

20.Insurance

Property Clearance Scotland Ltd maintains public liability and goods in transit insurance appropriate to our operations. Standard pricing does not include enhanced insurance for full replacement value unless expressly agreed in writing. Clients transporting high-value items are advised to arrange separate insurance cover.

21.Right to Refuse Unsafe Work

We reserve the right to stop or refuse works where abuse or threatening behaviour occurs, unsafe lifting risks exist, hazardous conditions are present, dangerous materials are discovered, or weather conditions create safety concerns. Attendance and labour charges may still apply.

22.Governing Law & Jurisdiction

These Terms and Conditions shall be governed by the laws of Scotland. Any disputes or proceedings shall be subject to the exclusive jurisdiction of the Scottish Courts.

Proceedings may be raised within the Sheriff Court having jurisdiction over the registered office of Property Clearance Scotland Ltd or the location where services were provided. Both parties agree to attempt amicable resolution prior to legal proceedings.

23.Debt Recovery & Enforcement

Failure to make payment in full shall constitute breach of contract. Property Clearance Scotland Ltd reserves the right to instruct debt recovery agents, solicitors, or sheriff officers and to commence legal proceedings without further notice.

The Client agrees that the following may be added to outstanding balances: £95 administration and recovery fee, debt recovery costs, court fees, sheriff officer fees, tracing fees, legal expenses, and interest permitted by law.

The Client remains liable for all recovery and enforcement costs until payment is made in full.
